Terms of Use

1. Introductory provisions

1.1. These Terms of Use (the “Terms”) govern the use of the TableMimic service available at tablemimic.com (the “Service”).

1.2. The Service is operated by Jan Barták (the “Operator”).

1.3. By using the Service or creating an account, you agree to these Terms.

2. Definitions

• User — a person using the Service.
• Account — a user account created by signing in through an identity provider (Google).
• User Content — content the User creates within the Service (characters, statblocks, notes, homebrew pages, etc.).
• Imported Content — content the User uploads or inserts into the Service from their own sources.

3. Account

3.1. An Account is created by signing in with Google. The User is responsible for activity on their Account.

3.2. The Service is not intended for persons under fifteen years of age. Younger persons may use the Service only with the consent of a legal guardian.

3.3. The User may have one Account and must not share or misuse it.

4. Acceptance and changes to the Terms

4.1. The Terms are accepted by active confirmation upon first sign-in.

4.2. The Operator may change the Terms. In the event of a material change, the User will be asked to accept them again. Continued use after accepting the new version constitutes agreement to it.

4.3. The notice will include a description of the changes and information about the option to cancel the Account if the User does not agree with them, including instructions on how to do so.

4.4. If the User continues to use the Service after the amended Terms take effect, this is deemed agreement to the new wording. If the User does not agree with the changes, they may cancel their Account at any time before the changes take effect.

5. User Content

5.1. User Content remains the property of the User. The Operator acquires no ownership rights to it.

5.2. The User grants the Operator a limited license to host, store and display User Content solely for the purpose of operating the Service for that User. This license does not include the right to further distribute, sell or use the content outside the operation of the Service.

5.3. The Operator claims no rights to the User’s homebrew content beyond operating the Service.

6. Imported Content and responsibility

6.1. The User is solely responsible for all Imported Content and represents and warrants that they hold the rights or license necessary for its upload and use within the Service.

6.2. The User must not upload content that infringes copyright, trademarks or other rights of third parties.

6.3. Imported Content is private, tied to the User’s Account, and the Operator does not distribute it to other users.

6.4. The Operator is not responsible for Imported Content and is entitled to remove such content upon notice of a rights infringement.

7. Prohibited conduct

The User must not, in particular:

• attempt to access other users’ data or bypass the Service’s security;
• disrupt the operation of the Service, load it with automated traffic beyond ordinary use, or download or otherwise extract its content beyond ordinary use;
• upload unlawful, harmful or rights-infringing content;
• use the Service to break the law.

8. The Operator’s intellectual property

8.1. The Service (code, design, the “TableMimic” brand, graphics) is the intellectual property of the Operator. The User only acquires the right to use the Service in accordance with the Terms.

9. Third-party content

9.1. Game content in the Service is based on openly licensed sources; their licenses and attributions are listed on the Licenses page.

9.2. TableMimic is an independent fan-made tool and is not affiliated with, endorsed or sponsored by Wizards of the Coast or any other rights holders.

10. Paid services

10.1. The core features of the Service are free. Paid features, their prices, billing, cancellation and refunds will be governed by separate payment terms or by an amendment to this section before payments are launched.

11. Availability and disclaimer of warranties

11.1. The Service is provided “as is”, without warranty of uninterrupted availability, freedom from errors or fitness for a particular purpose.

11.2. The Operator reserves the right to modify, limit or terminate the Service at any time.

12. Limitation of liability

12.1. To the extent permitted by law, the Operator is not liable for loss of data, outages, lost profit or indirect damages arising from the use of the Service.

12.2. Users are advised to back up their important data (export).

13. Personal data protection

13.1. The processing of personal data is governed by the Privacy Policy.

14. Termination

14.1. The User may cancel their Account at any time. Cancelled Accounts are handled according to the data life cycle (export available, data frozen, deletion per the Privacy Policy / these Terms).

14.2. The Operator may restrict or cancel an Account in the event of a breach of the Terms.

15. Governing law

15.1. The Terms are governed by the laws of the Czech Republic. Any disputes will be resolved by the competent courts of the Czech Republic.

15.2. The body competent for out-of-court resolution of consumer disputes arising from the contract is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, ID No. 000 20 869, website: adr.coi.cz.
