Terms of Use
1. Introductory provisions
1.1. These Terms of Use (the “Terms”) govern the use of the TableMimic service available at tablemimic.com and of the related tools at jonbarson.cz that share the same Account (together, the “Service”), and the rights and obligations between the Operator and the User.
1.2. The Service is operated by Jan Barták, company ID (IČO) 30053102, place of business Ledčice 146, 277 08 Ledčice, Czech Republic, a sole trader registered in the Trade Register kept by the Municipal Office of Kralupy nad Vltavou (the “Operator”).
1.3. Operator contact details: e-mail hello@tablemimic.com, phone +420 605 749 238, postal address Ledčice 146, 277 08 Ledčice, Czech Republic. The same address applies to complaints and notices.
1.4. By using the Service or creating an Account, you agree to these Terms.
2. Definitions
- User — a person using the Service.
- Account — a user account created by signing in through an identity provider (Google).
- User Content — content the User creates within the Service (characters, statblocks, notes, homebrew pages, maps, etc.).
- Imported Content — content the User uploads or inserts into the Service from their own sources.
3. Account
3.1. An Account is created by signing in with Google. The User is responsible for activity on their Account and for securing access to the Google account they sign in with.
3.2. The Service is intended for persons aged fifteen and over. A person under fifteen may use the Service only through an Account created and managed by their legal guardian; by doing so the guardian gives their consent and is responsible for how the child uses the Service. If the Operator learns that an Account was created by a person under fifteen without a guardian’s consent, it may cancel the Account after giving notice.
3.3. The User may have one Account and must not share or misuse it.
3.4. Some tools can be used without signing in (guest mode). The data is then stored only in the User’s browser: clearing the browser data deletes it irreversibly, it is not available on other devices, and the Operator cannot restore it.
3.5. The Service may be used for your own games, including running paid games and streaming or recording sessions in which the Service is visible. Without the Operator’s consent, the Service or parts of it may not be resold, offered as your own service or incorporated into other products.
4. Acceptance and changes to the Terms
4.1. The User accepts the Terms by active confirmation upon first sign-in. The current wording is always on this page; previous versions are archived (links in Section 16.4).
4.2. The Operator may change the Terms to a reasonable extent, in particular due to changes in legislation, development or changes of the Service’s features, security, or the introduction of paid features.
4.3. The Operator will announce a change at least 30 days before it takes effect, by a notice in the Service after sign-in and by publishing the new wording on this page together with its effective date. The notice includes a description of the changes, the effective date and information about the right to reject the changes, including instructions on how to cancel the Account.
4.4. If the User does not agree with the changes, they may reject them and terminate the contract by cancelling their Account at any time before the changes take effect. Cancellation is free of charge and without any penalty, and the User may export their data beforehand (Section 14). Until the changes take effect, the previous wording applies.
4.5. If, after proper notice, the User does not cancel their Account before the changes take effect, the changes are deemed accepted. If the User expressly confirms the new wording in the Service earlier, it applies to them from the moment of that confirmation.
4.6. The notice period under Section 4.3 does not apply to changes made solely in the User’s favour, to corrections of obvious errors and additions of information that do not affect the User’s rights and obligations, or to changes required by law or by a decision of a public authority within a shorter period.
5. User Content
5.1. User Content, including homebrew content, remains the User’s. The Operator acquires no ownership or other rights to it beyond the license under Section 5.2.
5.2. The User grants the Operator a non-exclusive, royalty-free, worldwide license to store, host, back up, temporarily cache, transmit and display User Content, including through the processors listed in the Privacy Policy. The license is granted solely for the purpose of operating the Service for that User and for the persons with whom the User chooses to share the content using the Service’s features (e.g. players at their table or the table display).
5.3. The license does not include the right to publish, further distribute, sell or otherwise use the content outside the operation of the Service.
5.4. The license lasts as long as the Account exists and ends when the Account is deleted, or, for individual content, when that content is deleted. Copies in backups are removed by ongoing backup rotation within 12 months at the latest; until then, backups are used only to restore the Service after a failure.
5.5. The Service currently does not allow User Content to be made public. If the Operator introduces public sharing, content will only be published upon the User’s express choice for that specific content; private content will never be made public without the User’s knowledge.
6. Imported Content and notices of illegal content
6.1. The User is solely responsible for all Imported Content and represents that they hold the rights or license necessary for its upload and use within the Service.
6.2. The User must not upload content that infringes copyright, trademarks or other rights of third parties.
6.3. Imported Content is private and tied to the User’s Account. The Operator does not distribute it to other users unless the User shares it using the Service’s features (Section 5.2).
6.4. The Operator has no obligation to actively monitor content stored by Users. This does not exempt it from responsibility once it becomes aware that content is illegal: upon notice it proceeds under Sections 6.5 to 6.8.
6.5. Anyone may report illegal content to hello@tablemimic.com (subject “Content notice”) or by post to the address in Section 1.3. The notice should identify the content as precisely as possible, explain why it is illegal, include the reporter’s name and contact details, and state that the information is provided in good faith.
6.6. The Operator will acknowledge receipt of the notice without undue delay and decide on it within a reasonable time, usually within 14 days. Manifestly illegal content may be disabled immediately. The Operator will inform both the reporter and the affected User of the decision and its reasons.
6.7. The affected User may object to the decision (counter-notice) within 14 days using the same contact. If the content turns out to have been removed without justification, the Operator will restore it. This does not affect the right to go to court.
6.8. Repeatedly uploading illegal content is a serious breach of the Terms and may lead to the cancellation of the Account (Section 14.4).
7. Prohibited conduct
The User must not, in particular:
- attempt to access other users’ data or bypass the Service’s security, authentication or technical limits;
- use bots, scrapers or other automated tools to download the Service’s content (e.g. the Compendium database) or to send requests in bulk; ordinary use means working with the Service through its interface in a browser;
- exceed the technical limits on the number of requests (rate limits); when they are exceeded, the Service automatically restricts access temporarily;
- decompile or otherwise reverse engineer the Service’s code in order to copy it or build a competing service, except where expressly permitted by law;
- upload unlawful, harmful (e.g. malware) or rights-infringing content;
- use the Service to break the law or to harass other users.
This does not affect rights under the open licenses of game content (Section 9), which can be exercised in relation to the source materials.
8. The Operator’s intellectual property
8.1. The Service (code, design, the “TableMimic” brand, graphics) is the intellectual property of the Operator. The User only acquires the right to use the Service in accordance with the Terms.
9. Third-party content
9.1. Game content in the Service is based on openly licensed sources; their licenses and attributions are listed on the Licenses page.
9.2. TableMimic is an independent fan-made tool and is not affiliated with, endorsed or sponsored by Wizards of the Coast or any other rights holders.
10. Paid services
10.1. The core features of the Service are free. Paid features are not offered yet, and none will ever be activated without the User’s express order.
10.2. Before launching paid features, the Operator will add, following Section 4, the price including VAT, payment methods, the duration and termination of subscriptions, information about the right to withdraw from the contract within 14 days including the exceptions for digital content, complaint rules, and information about functionality, compatibility and interoperability.
11. Availability, defects and complaints
11.1. The Operator provides the Service with professional care, in particular regarding security and regular backups of stored data. Uninterrupted availability is not guaranteed; short outages due to maintenance or failures at infrastructure providers may occur.
11.2. A User who is a consumer has the rights arising from defective performance under the Czech Civil Code, including the provisions on digital content and digital services. These Terms neither exclude nor limit those rights.
11.3. A defect (complaint) can be reported by e-mail, phone or post using the contacts in Section 1.3; please describe the defect, when it appeared, and the Account e-mail. The Operator will confirm receipt and resolve the complaint without undue delay, at the latest within 30 days of its submission.
11.4. The Operator may continuously develop and adjust the Service (new features, fixes, design changes). A material reduction of features or the discontinuation of the Service as a whole will be announced at least 30 days in advance in the Service and on the website, so that the User can export their data; for paid features, the Operator will refund the prepaid amount pro rata. An immediate restriction is permitted only where necessary for security reasons or required by law; the Operator will inform Users of it without undue delay.
12. Liability
12.1. The Operator is liable for harm caused by a breach of its obligations in accordance with the law. Towards a User who uses the Service in the course of their business, liability for lost profit and indirect damage is excluded.
12.2. Nothing in these Terms excludes or limits liability for harm caused intentionally or by gross negligence, for harm to a person’s natural rights, in particular to health, or the consumer’s rights arising from defective performance and other rights granted by mandatory provisions of law.
12.3. We recommend that you also back up your important data yourself (export in the account menu). This recommendation does not reduce the Operator’s duty of care for stored data.
13. Personal data protection
13.1. The processing of personal data, including the retention of data and backups, is governed by the Privacy Policy.
14. Termination
14.1. The User may terminate the contract at any time by cancelling their Account, either in the account menu (top right) via “Delete account”, or by a request sent from the Account e-mail to hello@tablemimic.com. Cancellation is free of charge and without a notice period.
14.2. Cancellation in the account menu takes effect immediately: the Account, the User Content in the database and uploaded files are deleted at once, and copies in backups expire under Section 5.4. Before cancelling, the User can download their data via “Export data”. A request by e-mail will be handled without undue delay, at the latest within 30 days.
14.3. If the User breaches the Terms, the Operator will first notify them in the Service or by e-mail, describe the breach and ask them to remedy it within a reasonable period, usually 14 days, during which the User may respond. If the breach is not remedied, the Operator may restrict the Account or terminate the contract. After termination, the Account remains accessible for data export for another 30 days; the data is then deleted.
14.4. The Operator may restrict or cancel an Account without prior notice only in the event of a serious breach of the Terms, in particular uploading illegal content, an attack on the security of the Service or on other users’ data, repeated breaches after a previous warning, or on the instruction of a public authority. Even then, the Operator will allow the User to export their User Content unless prevented by law or security reasons; illegal content will not be released.
14.5. Discontinuation of the Service as a whole is governed by Section 11.4.
15. Governing law and disputes
15.1. The Terms are governed by the laws of the Czech Republic. Any disputes will be resolved by the competent courts of the Czech Republic. If the User is a consumer habitually resident in another EU member state, this does not affect the rights granted to them by the mandatory provisions of the law of that state, nor their right to bring proceedings before the courts of their state of residence.
15.2. The body competent for out-of-court resolution of consumer disputes arising from the contract is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, ID No. 000 20 869, website: adr.coi.cz.
15.3. Compliance with consumer protection obligations is supervised by the Czech Trade Inspection Authority, and personal data protection by the Office for Personal Data Protection (Úřad pro ochranu osobních údajů).
